  • Save your house and car.

  • Keep our home's equity.

  • Stop harassing phone calls

  • Restructure your debt.

  • Make monthly payments you  can actually afford.
Experienced and aggressive Everett Chapter 13 bankruptcy attorneys working for you!

In an Everett Chapter 13 bankruptcy, you are required to make monthly payments to a trustee.  These payments are a requirement of Chapter 13 bankruptcy plan that is approved by the court.  Portions of these payments go to your creditors and Chapater 13 plans last from three to five years.

At the end of your plan, however, 100% of all qualifying debts are fully discharged.  This typically includes all unsecured creditors, such as credit cards, medical bills, Pay Day loans, etc., that are not paid under the plan.

An Everett Chapter 13 bankruptcy can help save your house from repossession or a Snohomish County foreclosure action.

One of the most powerful things that an Everett Chapter 13 can do is stop a home foreclosure or repossession.  If you have fallen behind on your mortgage payments but could stay current if only you didn’t have such large past due payments and late charges, an Everett Chapter 13 bankruptcy will allow you pay the amount that you are behind over three to five years instead of all at once.

If all you can afford to pay each month is your mortgage, you can pay as little as 0% on your unsecured debts such as credit cards, payday loans, medical bills, etc. in a Snohomish County Chapter 13 bankruptcy plan.

An Everett Chapter 13 bankruptcy also allows you to deal with tax debt and car payments, all in the same plan that saves your house.  If you are able to make your monthly mortgage payments, especially after freeing up additional monthly cash flow, a Snohomish County Chapter 13 bankruptcy can be a very powerful option for both getting back on your feet and saving your home from foreclosure.

If your house is worth less than the first mortgage and you have a second mortgage, you can remove the second mortgage from your house in an Everett Chapter 13 plan.  The second mortgage would then be paid the same way credit card debt or medical bills are paid in a bankruptcy – only what you can afford.

Our Everett Chapter 13 bankruptcy lawyers have saved countless hundreds of homes from foreclosure in recent years and are highly skilled at getting the most out of an Everett Chapter 13 plan for our clients.

Why else might I choose to file an Everett Chapter 13 bankruptcy versus a Chapter 7?

Other reasons you may want to file a Snohomish County Chapter 13 bankruptcy is to avoid problems that can arise in a Chapter 7.  If you have property that you can’t protect in a Chapter 7, a Chapter 13 may be the way to do that. If you pay as much through a Chapter 13 plan as you would pay by giving up property, you can keep that property and still get a fresh start in bankruptcy.

If you have given a large gift to or paid loans back to relatives or business partners, sometimes these “insiders” can be sued in a Chapter 7 and may be forced to turn over the gift or repayment to your creditors.  You can avoid this unpleasant situation by paying the same sum to through your Chapter 13 plan.

If you make above the average income, you may have to file a an Everett Chapter 13 instead of a Chapter 7.  How much you can afford is determined by a “means test”.  Even if you have to file a Chapter 13, you want an experienced, aggressive attorney to put together a plan that allows you to pay the lowest amount possible under the law.

In many respects, an Everett Chapter 13 bankruptcy is complicated and you should have an experienced Snohomish County bankruptcy attorney to help guide you through it.  In addition to filing the initial bankruptcy petition, additional work is often needed to get your Everett Chapter 13 bankruptcy plan confirmed.

Our Everett Chapter 13 bankruptcy attorneys have years of experience putting together the best plan possible for our clients.  Your creditors might not like our plan, but we are eager to fight for your right to get out of debt by paying what you can truly afford, not what your creditors think you should be able to afford.
